Limitations on the exercise of rights by the data holder

The General Data Protection Regulation (RGPD) establishes a list of rights to which personal data subjects are entitled. These rights must be exercised with the Controller, which must guide its conduct by the principle of transparency, thus allowing the data subject to understand how to properly exercise their rights and the rules to which they are entitled.


As such:

  • The information provided to data subjects must be concise, transparent, intelligible, and easily accessible, using clear and simple language; 
  • Children must be able to understand the information addressed to them;


However, the exercise of rights must be evaluated according to the context of the processing and the grounds of lawfulness.

Therefore, in the table below, we present the rights applicable to each legal basis:
